On 18 March 2022, a water tank manufacturing company was sentenced in the Beenleigh Magistrates Court for breaching section 32 of the Work Health and Safety Act 2011, having failed to comply with its primary health and safety duty under section 19 of the Act.  The defendant was fined $48,000 and no conviction was recorded.

On 16 March 2022, a company was sentenced in the Cleveland Magistrates Court for 19 breaches of the Electrical Safety Act 2002, having performed electrical work without holding an electrical contractor licence. His Honour Magistrate Sarra fined the company $76,000. No conviction was recorded.

On 16 March 2022, a worker was sentenced in the Cleveland Magistrates Court for breaching the Electrical Safety Act 2002 (“the Act”) by failing to comply with his electrical safety duties as a worker pursuant to section 39 of the Act, and performing electrical work without holding an electrical work licence. He was charged with two Category 2 (section 40C) offences, one Category 3 (section 40D) offence and eight offences against section 55. A global fine of $50,000 was imposed by way of penalty. No conviction was recorded.

On 14 March 2022, a property management company was sentenced in the Southport Magistrates Court for breaching section 32 of the Work Health and Safety Act 2011 (‘the Act’), having failed to comply with its primary health and safety duty under s19(1) of the Act. The defendant company pleaded guilty to the charge. Her Honour Magistrate Balic imposed a fine of $60 000. A conviction was not recorded.

On 10 March 2022, a steel fabrication company and worker were sentenced in the Ipswich Magistrates Court by his Honour Magistrate Kinsella for breaching section 32 of the Work Health and Safety Act 2011 (‘the Act’), having failed to comply with their duties under sections 19 and 28 of the Act, respectively. The company was fined $45,000 and the worker fined $3,500. No conviction was recorded against either defendant.

On 4 March 2022, a window tinting business was sentenced in the Holland Park Magistrates Court for breaching section 346(1) of the Work Health

On 17 February 2022, a truck driver was sentenced in the Longreach Magistrates Court for breaching section 32 of the Work Health and Safety Act 2011 (‘the Act’), having failed to comply with his health and safety duty under section 29(b) of the Act, as a person at a workplace. The defendant had pleaded guilty to the charge. Magistrate Courtney fined the defendant $5000. No conviction was recorded.

On 15 February 2022, a partner of a wholesale meat supplier business was sentenced in the Richlands Magistrates Court for breaching section 32 of the Work Health and Safety Act 2011 (‘the Act’), having failed to comply with its health and safety duty under section 21 of the Act to ensure, so far as reasonably practicable, the plant at the workplace was without risk to the health and safety of any person.

On 14 February 2022, the defendant was sentenced in the Southport Magistrates Court for numerous breaches of the Electrical Safety Act 2002 (‘the Act’). The defendant conducted a business including performing electrical work without holding an electrical contractor’s licence or electrical work licence, contrary to sections 56 and 55 of the Act. Additionally, the defendant, as a person who had a primary electrical safety duty, failed to ensure the business was conducted in a manner that was electrically safe, and exposed individuals to a risk of death or serious injury on three separate occasions.  

On 24 January 2022, the defendant company was sentenced in the Beenleigh Magistrates Court for breaching section 335(1) of the Work Health and Safety Regulation 2011 (‘the Regulation’), having failed to ensure a hazardous chemical was correctly labelled as soon as practicable after importing the chemical. Magistrate Kilner convicted and fined the defendant $6,000. No conviction was recorded.
